Luxury Pickle Travel – Booking Terms & Conditions
These Booking Terms & Conditions (“Terms”) form part of the agreement between you (“Traveler,” “you,” or “your”) and Luxury Pickle Travel, Inc. (“LPT”) and K&E Travel, Inc. (“K&E,” together, “the Companies”) regarding your purchase of and participation in any LPT-curated or customized travel experience (“Experience”).
By submitting payment, signing a booking form, or otherwise confirming participation, you acknowledge that you have read, understood, and agree to be bound by these Terms as well as:
- the Website Terms & Conditions, and
- the Master Participant Waiver & Release of Liability (and any applicable addenda).
1. Contracting Entities
- Luxury Pickle Travel, Inc. operates as the marketing and brand platform for all Experiences.
- K&E Travel, Inc., a Florida-licensed Seller of Travel (License No. [insert]), acts as the booking and fulfillment agent responsible for processing payments, issuing travel documents, and coordinating with suppliers.
All travel contracts and receipts are issued by K&E Travel, Inc.
2. Reservations and Payments
- Deposits: A non-refundable deposit (amount specified in your trip summary) is required to confirm your space.
- Final Payment: The remaining balance is due no later than the date stated in your confirmation (typically 90 days prior to departure).
- Late Payments: Failure to make final payment by the deadline may result in cancellation and forfeiture of your deposit.
- Payment Methods: Payments are accepted via the secure methods specified on your invoice or booking portal (e.g., bank transfer, credit card, Stripe).
3. Pricing and Currency
All prices are quoted in U.S. Dollars unless otherwise noted.
Prices are subject to change due to currency fluctuations, government fees, taxes, or supplier surcharges until your booking is fully paid.
4. Cancellations and Refunds
Because each Experience is highly customized and space is limited, cancellation fees apply as follows (unless trip-specific terms state otherwise):
| Days Before Departure | Cancellation Fee |
| 121 + days | Loss of deposit only |
| 91 – 120 days | 50 % of total price |
| 0 – 90 days | 100 % (no refund) |
- Cancellations must be received in writing.
- No refunds will be given for unused services, voluntary changes, or no-shows.
- If the Experience is canceled by the Companies (other than for force majeure), all payments will be refunded in full, which constitutes full settlement.
5. Changes and Substitutions
We reserve the right to modify itineraries, accommodations, or activities when reasonably necessary due to weather, safety, supplier availability, or other factors beyond our control.
If material changes occur, we will provide equivalent or superior alternatives whenever possible.
Participant substitutions may be permitted subject to approval and any supplier fees.
6. Force Majeure
The Companies shall not be liable for any failure to perform resulting from causes beyond their reasonable control, including but not limited to acts of God, natural disasters, pandemics, labor disputes, political unrest, or transportation disruptions.
In such cases, we will make reasonable efforts to reschedule or issue travel credits at our discretion.
7. Required Travel Insurance
All travelers must maintain comprehensive travel insurance, including:
- Trip cancellation/interruption coverage;
- Emergency medical and evacuation benefits; and
- Baggage and travel-delay protection.
Proof of coverage is required before final documents are issued. Travelers without proof may be denied participation without refund.
8. Traveler Responsibilities
You are responsible for:
- Ensuring your passport, visas, and health documentation are valid;
- Meeting vaccination and entry requirements;
- Acting with respect and safety during all activities; and
- Complying with all local laws and instructions from guides or staff.
9. Health and Fitness
You must advise us of any medical conditions, mobility limitations, or dietary needs that could affect participation.
We reserve the right to decline any individual deemed unfit or unsafe to participate.
10. Independent Contractors
Local guides, transport providers, hotels, and activity operators are independent contractors, not employees or agents of the Companies.
The Companies are not responsible for their acts, omissions, or negligence.
11. Limitation of Liability
To the fullest extent permitted by law, LPT, K&E, and their affiliates shall not be liable for any indirect, consequential, or punitive damages.
Total liability shall not exceed the amount paid for the Experience.
12. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the State of Florida.
Any dispute shall be resolved exclusively through binding arbitration in Palm Beach County, Florida, pursuant to the rules of the American Arbitration Association (AAA).
You waive the right to a jury trial or class action.
